Do I have to use an insurance check to fix my car?

A woman hit my car in the parking lot at work a few weeks ago. I'm getting a check from her insurance company to fix it. My question is do I have to use the check to fix my car or can I spend it elsewhere and just deal with a car that has slightly less value?

  3. You got it. However if you don't fix it and it's hit again the estimates would be adversely affected. It's usually fairly easy to distinguish old from new damage, but not always.
  4. If you owe money on it (like a bank loan), then get it fixed. If you out-right own the car then there will be no legal repercussions (which can happen if you owe money on it).
  5. You do not have to repair the vehicle. The third party insurance company does not care if you repair the vehicle. Their insured was legally liable for the damage to your vehicle, and they are making you whole. As stated, if you are involved in another accident, the "old" damage will be deducted from your settlement.
  6. You are free to spend the check on beer, CD's, food, bills, drugs, etc. It's your money.
