I was in a car accident where the other party was at fault, but has no insurance, so how can I make her pay?

I don't have any insurance either. The woman disobeyed a give way sign and now my car is a write-off. She said she would pay for damage and towing costs, but now she won't answer her phone. I've had to pay the towing fee ($215) and have no way to get another car. What can I do, legally speaking? I'm in Australia. The Police were at the scene and several ambulances were called out.

1. In United States, depending on the amount of the damage, you would either take her to small claims court or get an attorney and sue her for the damages along with cost to recover.
2. this happens a lot. your first major mistake was in not having the police involved at the accident. You will have to get an attorney now and you still may not get anything if she has nothing. sorry
3. , take civil action against her.Make sure you have reports 0n all costs incurred.Detailing what where when the accident occured you do not state the year or day and time .However try going through the small claims court good luck and keep us all updated on your progress ....I see you have include d police ambulance attended the scene now you have proof . Ask for police and ambulance for copies of their incident reports now.....DO not delay any longer age does not matter.

I would go but the cheapest old truck I could find (maybe 2 or 3 of them) Wait for this person to buy a new car, then go smash into it,........................then wait till they get another car and smash into it,............................maybe smash it through this persons house,................................you get the idea.
